1. Introductory Provisions

The provision of accommodation and other services to clients and the accommodation of clients in the cottage Dom na konci is governed by generally binding legal regulations valid in the territory of the Slovak Republic and these General Terms and Conditions (hereinafter referred to as "GTC"), which also serve as accommodation rules. The client accepts the GTC as a contractual condition for accommodation in the cottage Dom na konci and for using the services provided by the Operator and is obliged to comply with their provisions.
The GTC are published on the website www.domnakonci.sk.
The Operator reserves the right to unilaterally change the provisions of the GTC, with the change becoming effective from the date of publication on the website.
 

2. General Terms and Conditions

These GTC apply to contracts for the accommodation of persons in the cottage Dom na konci, contracts for the rental of accommodation facilities and other facilities in the cottage Dom na konci for events and for holding events for rent, as well as for all other services provided to the client by the Operator. Other business and contractual conditions apply to the relationship between the Operator and the client only if they are agreed in writing in advance between the contracting parties.
The accommodation contract between the Operator and the client is created by written confirmation of the client's oral or written request for accommodation reservation in the cottage Dom na konci. The accommodation contract is concluded for a definite period.
The contracting parties are the Operator and the client. When ordering accommodation or other services by a third party, this person is liable to the Operator together with the client as a joint debtor for all obligations arising from the contract.
Any sublease or further rental of rooms or facilities of the cottage Dom na konci, as well as their use for purposes other than accommodation, or for purposes other than those contractually agreed, require prior written consent from the Operator.
 

3. Conditions for Providing Accommodation Services to Clients

The Operator can accommodate in the cottage Dom na konci only a client who is properly registered for accommodation. The client will be handed the keys after payment is credited, upon arrival before the start of accommodation. The entrance keys must be returned upon departure.
Reservations can be made in one's own name or on behalf of a third party through the reservation system on the website www.domnakonci.sk.
In exceptional cases, the Operator may offer the client other accommodation than agreed, provided it does not significantly differ from the accommodation agreed in the confirmed order.
Unless otherwise agreed with the client, the reserved accommodation in the cottage is available to the client from 16:00. The client has no legal right to earlier use of the reserved accommodation in the cottage.
In case of deficiencies in the provided accommodation or supplementary service, the consumer shall exercise the right to complaint without undue delay. After the warranty period expires, the right to complaint ceases. (The consumer shall present proof of payment for the services whose defects are being complained about when making a complaint).
The accommodation used by the client must be vacated and handed over to the Operator by the client no later than 10:00 on the agreed day of departure.
Accommodation is considered vacated and handed over to the Operator after the client has removed all their belongings. The Operator reserves the right to check the room inventory, payment, and possible consumption by the client no later than two hours after the cottage is vacated and handed over by the client. The price list of damages and inventory is available on the website www.domnakonci.sk.
The reserved type of accommodation, which the client has not moved into by 22:00 on the agreed day of arrival, may be rented by the Operator to a third party. This does not apply if a later arrival of the client has been expressly agreed between the Operator and the client.
If the client requests the Operator to extend the agreed accommodation period, the client has no right to accommodation in the type of accommodation in which they were originally accommodated, if it is not possible to provide accommodation to the client due to capacity or operational reasons.
The client is entitled to use the services of the Operator only if they agree with the GTC. The client is advised to familiarize themselves with these GTC before making a reservation in their own interest. When repeatedly using the services of the cottage Dom na konci, the client is obliged to always familiarize themselves with the current wording of the GTC. By confirming the reservation, the client confirms that they have familiarized themselves with the Terms and Conditions and their attachments, agree with them, and undertake to comply with them.
 

4. Payment for Provided Services

The price list of services provided by the Operator is available on the website www.domnakonci.sk.
The price of a recreational stay in the cottage Dom na konci includes: the price of accommodation for the entire property including the garden, the price for parking, and Wi-Fi connection.
The Operator requires an advance payment from the client in the amount of 50% of the total amount with payment within 48 hours, after which the term will be confirmed.
The Operator accepts cashless payments (bank transfer).

The client is obliged to pay the agreed contractual prices according to the price list for accommodation and other services used. The Operator does not have a fixed price list, only indicative, which changes according to the current period and occupancy.
If the client shortens their agreed stay in the cottage, the Operator has the right to charge the client the full agreed price for the entire length of the agreed stay in the accommodation facility.
If the stay is canceled by the Operator after the advance payment, the Operator will return the already paid advance back according to the cancellation conditions, see Article 6 of these GTC.
If the Operator does not receive payment for the stay within the due date, or a written statement about the change of the due date, the reservation of the stay is canceled.

5. Responsibility of the Client and the Operator

The Operator is not responsible for damage to items brought in and stored by the client in the premises of the cottage or in the cottage area. The Operator is not responsible for jewelry, money, and other valuables.
The Operator is not responsible for forgotten and lost items of the client in the premises of the cottage and the adjoining gardens. Found items are sent to the client by mail based on the client's written request. The Operator stores found items for one month.
The Operator is not responsible for possible injuries during the stay.
The client's duty is to always behave in a way that does not endanger their health or the health of other guests.
The client is responsible for damages caused by them in full and is obliged to pay the full amount of the damaged item immediately.
In case of gross violation of accommodation conditions, including vulgarities, violence, inappropriate behavior, the client may be asked to leave the property immediately without the right to a refund of the already paid stay.
In the accommodation facility and in the premises of the cottage Dom na konci, the client must not move the Operator's equipment without the Operator's consent or make any modifications or interventions to the Operator's equipment.
In the accommodation facility and in other premises of the Operator, the client must not use their own electrical appliances without the Operator's consent.
For safety reasons, the client is not allowed to leave children under 10 years of age without adult supervision in the accommodation facility or in other premises that are part of the cottage Dom na konci. The parent/responsible person is responsible for the safety and damages caused by children in the accommodation facility or in other premises and gardens.
The client is not allowed to bring weapons and ammunition into the cottage.
From 22:00 to 8:00, the client must strictly observe night peace in the entire area and in the accommodation facility.
Accommodation of animals is allowed without charge after agreement with the Operator.
Arrival with a pet must be announced in advance. The pet must have a valid vaccination certificate upon arrival and must not be infested with fleas.
If the animal contaminates the cottage area with feces, the animal owner/responsible person is obliged to remove the feces immediately, otherwise the Operator is entitled to charge a fine of 100 EUR.
The animal owner/responsible person is responsible for damages and contamination caused by the animal, as well as for the animal itself. Bathing the animal is prohibited in the premises of the cottage.
In the accommodation and social facilities of the area, smoking and the use of any narcotic and psychotropic substances are strictly prohibited. The Operator is entitled to charge an amount of 300 EUR for violating this prohibition. Smoking is allowed only in outdoor areas. Under no circumstances inside the cottage.
If the Operator provides the client with a parking space for the client's motor vehicle in the area, the Operator is not responsible for the loss or any damage to the client's motor vehicle and items located in this motor vehicle.
Parking in the area is only possible in designated places.
It is forbidden to start a fire, make bonfires, grill, or manipulate fire in any way outside the designated areas in the cottage.
Complaints from clients and possible suggestions for improving the Operator's activities are accepted in writing by the owner of the facility at info@domnakonci.sk.
The client is obliged to close water valves, turn off electrical lighting and other appliances (stove, oven, etc.) and close the doors when leaving the room.
Accommodation must be handed over in the condition in which it was taken over = without damage to structures and equipment, inventory and equipment of the cottage in the same place and in the same number as upon arrival, kitchen utensils washed, dried, and stored in the appropriate place. If these conditions are not met, the Operator reserves the right to charge an additional fee for services beyond the agreed ones. Additional service – washing and storing kitchen utensils, or moving furniture to its original place is charged a one-time fee of 150 EUR. In case of any damage to inventory/accommodation, the client is obliged to report this situation to the Operator before checking out of the accommodation.
The client is not allowed to bring sports equipment and items of outdoor character into the interiors of the cottage.
If the guest causes damage to the property in the accommodation facility, the Operator is entitled to financial compensation for the damage directly on the spot. The amount will be specified based on the acquisition price. If the owner of Dom na konci and the guest do not agree immediately and voluntarily on the spot, the Operator has the right to call the police patrol to resolve the damage.
In case of violation of the obligations and prohibitions stated in this article of the general terms and conditions/accommodation rules, the Operator is entitled to demand payment of a contractual penalty of 100 EUR from the client for each individual violation of obligations.
 

6. Withdrawal, Change or Cancellation of Order and Cancellation

The client has the right to withdraw from the contract at any time before the start of accommodation by written notice to the Operator. Any change in the confirmed order (number of persons, change in the scope of reserved services, restriction or expansion, etc.) must be reported no later than 72 hours before the start of the stay. Such changes are possible only if the operational or capacity possibilities of the operator allow.
The amount of cancellation fees for canceling a reservation. The cancellation fees stated in this point apply to reservations received from 1.5.2024.
If the reservation is canceled more than 30 days before the date of arrival, 0% of the stay price will be charged, meaning the client will be refunded the full amount of the reservation.
If the reservation is canceled less than 30 days and more than 15 days before the date of arrival, 50% of the stay price will be charged, meaning the client will be refunded 50% of the reservation amount.
If the reservation is canceled less than 14 days before the date of arrival, 100% of the stay price will be charged. Additional rules:
If the client has prepaid a stay of higher value than their stay on the new date, the difference in the amount from the original payment will be used as a deposit for additional services in the cottage. The provider does not refund the difference in price to the client.
If the client has prepaid a stay of lower value than their stay on the new date, the Operator will calculate the difference, which the client is obliged to pay as a supplement for the stay.
Such a transferred stay can no longer be repeatedly transferred and is subject to cancellation conditions according to the new stay date. The Operator is entitled to withdraw from the contract if:
An event of force majeure occurs or other circumstances arise for which the Operator is not responsible, as a result of which the fulfillment of contractual obligations becomes impossible.
The client provided misleading or false information regarding essential facts for the conclusion of the contract when reserving the accommodation facility.
The Operator reasonably believes that the use of its services could endanger the operation of the facility, the safety of third parties, or the seriousness and good reputation of the Operator Dom na konci.
In case of withdrawal from the contract by the Operator, the client is not entitled to severance pay, compensation, or damages.
 

7. Protection of Personal Data

The client, in accordance with the provisions of Act No. 18/2018 Coll. on the protection of personal data as amended, declares that they have been informed of the rights and obligations regarding the acquisition and processing of personal data by the Operator under this Act.
The client grants the Operator consent to acquire, process, and store the client's personal data stated in the request for reservation of the accommodation facility or in the order, for the purpose of ensuring and providing the services ordered by the client by the Operator and for fulfilling the Operator's obligations imposed by law for the necessary period.
The client grants the Operator consent to acquire and process personal data also for the needs of the Operator's marketing activities, especially for participation in the Operator's emailing or loyalty programs, for the period during which these activities are carried out.
By providing personal data, the client gives consent for their storage in the company's database and information system. The Operator has developed security documentation to ensure the protection of personal data. Only persons instructed under the law work with personal data.
All personal data acquired during visits to the website www.domnakonci.sk are processed in accordance with the law.
The Operator declares that it does not sell, trade, or otherwise provide the client's personal data to third parties.
The client's consent can be revoked in writing with or without stating a reason.
 

8. Final Provisions

If any provision of these GTC is or becomes invalid or unenforceable, it does not affect the legality, validity, or enforceability of the remaining provisions of these GTC, except if the importance or other circumstances related to the invalid provision of these GTC mean that the provision cannot be separated from the remaining provisions of these GTC.
These GTC and legal relationships arising from them are governed by the legal order of the Slovak Republic.
These GTC become valid and effective on 1.5.2024.

The client confirms that they are familiar with the general terms and conditions and agree with their content by delivering the reservation, confirming it, and subsequently paying the deposit for the services.
